Terms Conditions of Service for Ringtones-n-Ringtones ("hereafter referred as The Company") You as a registered User (Hereafter referred as The Customer), agree to provide true and accurate information in all of your dealings and communications with The Company. The Customer further agrees that they will not use the Service for any illegal purpose, or for the transmission of information that is libelous, unlawful, harassing, abusive, threatening, abusive of another's privacy, harmful, vulgar, defamatory, obscene, pornographic, or in anyway that may infringe the laws governing or any other material that is slanderous, defamatory or might cause offence in anyway.

ACCEPTANCE OF TERMS OF SERVICE The Customer hereby takes note and accepts that The Company may at any time change, vary or modify these "Terms & Conditions" without any prior notice.

DESCRIPTION OF SERVICE The Service is available at the mzone Website and includes everything on the website that may exist from time to time. Part of the Service makes available to you downloadable mobile entertainment, such as ringtones, wallpaper, games and graphics (collectively, the "Downloads"). Once properly registered and after making proper payment, you will be permitted to download to compatible wireless telephones and other compatible devices certain Downloads through the Service. We make no representation as to compatibility of your wireless phone with our website.

DELIVERY OF PRODUCT Delivery of Product(s) purchased pursuant to these Terms will be made directly to your cellular phone. The details of the delivery process will be provided to you at the time of purchase. Delivery is conditional. In order for proper delivery, your cellular phone must be turned on; capable of receiving the Product(s); set to receive text messages (Please note that not all mobile phones allow the storage of new ringtones). Ordered Product(s) can only be delivered when the cellular phone is on a compatible network, a full list of which is available on the site. Provided that the cellular phone and cellular phone provider's network will accept the Product(s), delivery of the Product will occur within 24 hours of completion of the order. Typically, delivery of the Product(s) occurs within a matter of seconds. If the Product(s) has not been successfully delivered, please notify us within 7 days. If you do not notify us within this period, we will presume that the Product(s) has been received. If the Product(s) cannot be delivered, mzone.wire2air.com will refund the payment, provided that the Product's non-delivery to the cellular phone is not the result of the buyer's error. If the buyer's error caused the non-delivery, payment will not be refunded.

MODIFICATIONS TO SERVICE The Company reserves the right to amend, modify, change, or discontinue temporarily or permanently any service at its sole discretion without any notice to The Customer. The Customer also agrees that The Company shall not be liable to The Customer, or any third party, for any modification, or discontinuation of any service in what so any form.

THE CUSTOMER'S RESPONSIBILITIES The Customer accepts the following; to obtain, and maintain suitable equipment to utilize the Service. To obtain all necessary permissions to use the Service, to receive, download, display, distribute or execute other programs or perform other works. To comply with applicable laws, regulations, or conventions including those related to data privacy, telecommunications, and use of technical or personal data.

INDEMNITY The Customer should understand the fact that The Company and it's Partners, affiliates, officers and employees are free from any claim or demand, including any made by a third party, arising out of the use of the Service. The Customer agrees not to hold The Company and it's Partners, affiliates, officers and employees responsible for any direct or indirect damage resulting from the use of the Service, in particular, but not limited to; the use of, or the impossibility of using the Service, confidence in information obtained through the Service, errors and omissions, defects, viruses, delay in transmission, interruption of service or loss of data. Further, The Company disclaims, any responsibility for the performance of it's messaging, or telephone services and The Customer takes notice of this and agrees.

MAINTENANCE The Service may be stopped or suspended for maintenance. No indemnity can arise from such events.

PROPRIETARY RIGHTS The Customer acknowledges that the content, including but not limited to text, software, graphics, images, music, sound, logos, video, or any other material contained in The Company's sites and services, or those of any advertiser, or sponsor, are protected by copyrights, trademarks, patents, service marks and other proprietary rights in law. The Customer may not copy, distribute, reproduce, or transmit such works, information or content without express authorization.   All the content sold on this site are done so with out any knowledge of any copyright infringement and royalties if any are paid to the best of our knowledge. If you are the owner of the copyright or you perceive an infringement or an authorized person and wish items removed please contact us, and they will be taken off the site immediately.

DISCLAIMER OF WARRANTIES The Customer expressly agrees the use of the Service is at their sole risk. The Company expressly disclaims all warranties of any kind, whether express or implied. The Company makes no warranty that the services will meet The Customer's requirements, or that the services will be uninterrupted, timely, secure, or error free; does not make any warranty as to the results that may be obtained through the service or that defects in the software or systems may be corrected. The Customer understands and agrees that any material and/or data uploaded or otherwise obtained through the use of this Service is done at The Customer's sole discretion and risk and that The Customer will be solely responsible for any damage to their computer system or loss of data that results from the download of such data or material. No advice or information, whether oral or written which was obtained from The Company or through the Service shall create any warranty not expressly made herein. The quality of content might vary from what is preview to what is actually received in the customer's mobile phone owing to difference is what is perceived in the Customer's PC console and the mobile phone console. The Company will not be held responsible for any such differences.

LIMITATION OF LIABILITY The Company shall not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data, or loss of profits arising out of, or in connection, with these "Terms & Conditions".

NOTICE Any notice to The Customer or to the Service shall me made by e-mail, SMS or posting on the website.

GENERAL These "Terms & Conditions" will be governed and construed in English law. If any of the provision of these "Terms & Conditions" is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. The Company failure to act with respect to a breach by Users does not waive its right to act with respect to subsequent or similar breaches.
